Plain-language summary
Written by a model from the explanatory memorandum; not the record, as at 2016-03-03.
This bill updates Commonwealth laws so that Northern Territory Local Court judges can keep doing work that magistrates used to do.
It changes definitions in the Acts Interpretation Act 1901 and many other federal Acts to match the new court structure created by the Northern Territory's Local Court Act 2015.
The changes take effect from 1 May 2016, when the Northern Territory Local Court replaces the old Court of Summary Jurisdiction and magistrates become judges.
- Amends the Acts Interpretation Act 1901 so that references to 'magistrate' in Commonwealth law also cover Northern Territory Local Court judges.
- Amends several other Commonwealth Acts that define 'magistrate', 'judge' or 'court of summary jurisdiction' to include the Northern Territory Local Court.
- Ensures that references to 'judge' in Commonwealth law do not generally include Northern Territory Local Court judges.
