This bill would abolish the Australian Customs and Border Protection Service and create the Australian Border Force within the Department of Immigration and Border Protection from 1 July 2015.
It repeals the Customs Administration Act 1985, transfers customs powers to the Comptroller-General of Customs, and extends the integrity agency ACLEI's oversight to the new department.
The bill also lets the ABF Commissioner, after consulting the Secretary and the Director-General of Security and with the Employment Minister's agreement, declare that parts of the Work Health and Safety Act 2011 do not apply or apply with changes for ABF workers.
- Repeals the Customs Administration Act 1985 and abolishes the statutory office of the CEO of Customs.
- Confer on the Comptroller-General of Customs all powers and functions currently held by the CEO under the Customs Act and other Commonwealth Acts.
- Extend the Australian Commission for Law Enforcement Integrity's jurisdiction to cover the whole integrated Department.
- Update terminology in the Customs Act and other Acts to remove references to the abolished ACBPS.
- Amend the Work Health and Safety Act 2011 to allow the ABF Commissioner to declare that certain provisions do not apply or apply with modifications for ABF workers.
